England: Legislative amendments to increase planning application fees in England have been made and will come into effect on 6th December 2023.

The main points are that: 

  • All application fees will be increasing by 25%, including householder applications, except for applications for “major development” which will increase by 35%.
  • The ‘free go’ on resubmitted applications will be removed. The legislation includes transitional arrangements, whereby applications that were already eligible for a free resubmission prior to the change (i.e. before 6th December 2023) will remain eligible for a ‘free go’.

  • The amendment introduces an annual rise in application fees linked to inflation (and capped at 10%) every April from 2025 onwards

The legislative changes are contained within The Town and Country Planning (Fees for Applications, Deemed Applications, Requests and Site Visits) (England) (Amendment) Regulations 2023.

The fee increases have come forward as a direct response to the Department for Levelling Up, Housing and Communities (DLUHC) consultation on the Stronger performance of local planning authorities supported through an increase in planning fees’ which was undertaken in Spring 2023.
