
BCP Council (former Borough of Poole): Dan Wilden is pleased to have won an appeal against the BCP Council and secured planning permission for a replacement dwelling at a site in the Hillbourne area of Broadstone.
The application site contained a small dwelling which was originally an outbuilding to the main house. The building had become lawful as an independent dwelling through use as such for sufficient period of time without enforcement and a certificate of lawfulness had been obtained. The appeal proposal was to replace this small dwelling and its adjacent garage with a larger contemporary bungalow with flat green roof designed by Jolp.
The Council turned down the application on grounds it would: harm the character of the locality, harm the living conditions of the adjoining original house, and have a detrimental impact on trees. On appeal we argued that the proposed bungalow would do none of those things and the Inspector agreed – subject to conditions to ensure the protection of the trees.
Perhaps the most noteworthy thing about this appeal was the length of time to receive the decision – just shy of 11 months in total from the submission. This was unusual even by the Planning Inspectorate’s current standards which are more typically in the order of 6-7 months or so for this appeal type.
