BCP Council (Poole area): Neil McKeon has recently won a householder appeal against BCP Council and secured planning permission for alterations, extensions and remodelling of a property in Links Road, Poole. The proposal sees the extensive remodelling of the existing bungalow to create a 4 bedroom contemporary style dwelling.

The application followed a previously approved application to remodel the existing bungalow with a hipped roof form. The revised scheme (designed by LMA Architects) proposed a flat roof design to the two storey house – which the LPA opposed on grounds of failing to preserve the character and appearance of the area and being out of keeping with the pattern of development.

Within our statement of case, a substantial contextual appraisal was undertaken of all surrounding streets to establish the variety of roof form and larger replacement dwellings in the surrounding environs – all of which contribute to the character of the area. In determining the proposal, the Inspector agreed with our assessment. In allowing the appeal, the Inspector disagreed with “the Council’s contention that this appears boxy or out of keeping with the local pattern of development”. The Inspector solidified this position noting “Moreover, as the flat roof would result in a reduction in the height of the remodelled building, the appeal proposal would appear to sit more comfortably on the site than the approved November 2021 scheme”.

The Inspector’s decision concluded that the revised dwelling was fully policy compliant and was an improved scheme from that of the previous scheme, which the LPA had accepted – much to the client’s delight.
