BCP Council (Poole): Dan Wilden is pleased to have won an appeal against BCP Council in relation to a householder planning application in Poole near to Harbourside Park.

Our client approached Pure Town Planning after two seperate planning applications for a loft conversion had been refused by the Council. We suggested that it would be worth giving it a try on appeal as it appeared likely that the Council were not going to permit any kind of dormer window of sufficient size at the three-storey mid-terrace property.

We produced an appeal statement highlighting the diverse roofscape of the locality and also highlighting a number of other dormer windows in the vicinity which had not had a detrimental impact on the character of the estate. In the decision the Inspector agreed and found: “The proposal would not result in an overly dominant or incongruous features and would preserve the character and appearance of the area.”

All too often we find local authority planners being overly protective when it comes to relatively benign changes. In these circumstances sometimes an appeal can be the only way forward. However under recent changes to the appeal system, you cannot add to your case at the appeal stage and therefore it is now increasingly important that the prospect of an appeal is fully considered before the planning application is submitted in the first place – not just for householder but for all applications. This is why we advise clients seeking the assistance from a planning consultant before applying, not just once it has been refused.
