BCP Council (Poole Area): Neil McKeon has won an appeal against BCP Council and secured planning permission for a detached garage with first floor home office and pedestrian access to the public footway on Clifton Road, Poole.

The Council refused the application in June 2024 on grounds that the two storey scale to the front of the site constituted an incongruous feature in the street scene, thereby harming the character and appearance of the area, as well as creating an overbearing impact on the front elevation bedroom window. Following the refusal, the applicant approached Pure Town Planning to review the case and challenge the decision at appeal.

The Inspector confirmed that the two storey front extension, due to the changing land gradient, would be perceived as single storey from the street scene, with a design and material finish which melded comfortably with the house. The Inspector noted that the development would not appear out of place amongst the mixed character of Clifton Road. Whilst the two storey building would ordinarily be viewed as unconventional, the setting and context of the appeal site, as justified in the submitted appeal statement, weighed heavily in the Inspector’s assessment and acceptability of the proposal – contrary to the Council’s determination. The Inspector also overturned the Council’s objection to the perceived harm to the outlook of the front elevation first floor bedroom window – allowing the appeal, which was welcomed news to the applicant following the initial refusal.
