
London Borough of Hounslow: Chris Miell has recently won an appeal against the London Borough of Hounslow and secured planning permission for the demolition of the rear existing garden shed and the erection of a rear outbuilding, which will provide the home owner with an office, gym and garden store, in Isleworth, London.
In assessing the original planning application, the LPA the Council concluded that the proposed outbuilding would not be incidental to the main dwelling and alleged that it could be used as independent accommodation due to the inclusion of a bathroom. Within our statement of case, we argued that it was wholly reasonable for an outbuilding to provide bathroom facilities, which would allow the applicant to shower and take comfort breaks whilst working from home or using the gym. We also explained that the building could not form an independent unit accommodation of accommodation because it was at the rear of the plot with no means of separate access, other than through the parent dwelling.
In determining the proposal, the Inspector agreed with our assessment. In allowing the appeal they concluded that “The inclusion of bathroom would allow for comfort breaks and provide the opportunity for showers for users of the office and gym area. Given that the proposal would lack other facilities such as a kitchen, living area or bedroom, I see no reason why the inclusion of a bathroom would necessarily result in the use of the building as a separate dwelling. Indeed, as it would also only be possible to access the outbuilding via the main dwelling, it would be unlikely that this arrangement would be compatible with the use of the existing dwelling.”
