BCP Council (Poole area): Neil McKeon is pleased to have secured approvals against two enforcement notices by BCP Council in respect to the commercial premises at South Deep at Parkstone Bay Marina, Poole. South Deep is a popular destination for food and drinks on the waterfront with expansive views of the marina.

The enforcement notices from the Council were against the erection of a canopy extension with retractable roof and seating area at South Deep. The second enforcement notice was against the erection of ‘The Sipping Container’ which provided additional bar services on site. The Council’s primary concern was in respect to the unauthorised development and the potential flood risk implications.

The applicant instructed Pure Town Planning to handle the dual appeal challenge against both enforcement notices. Given the site’s sensitive location within Flood Zone 3a, a detailed flood risk assessment was carried out by Godsell Arnold Partnership Ltd. The flood risk mitigation measures were submitted with Pure Town Planning’s appeal statement to confirm compliance with planning policy in all respects.

The Council assessed the submitted statement and flood risk assessment and confirmed that both aspects of the dual appeal adhered to adopted policy and so no further objection was raised. The Inspector agreed with this position and subsequently quashed the enforcement notices and granted retrospective planning permission for the canopy extension, retractable roof in connection with the additional seating area and ‘The Sipping Container’.
