BCP Council (Poole area): Matt Annen is thrilled to announce that he has secured planning permission for a Section 73 material minor amendment — transforming House 1 of an approved two-dwelling scheme from a flat-roofed contemporary house into a traditional, Georgian-inspired mansion, complete with a detached garage. This scheme was beautifully designed by ARC Architecture.
The background
Planning permission was granted in October 2025 for the demolition of the existing dwelling and the erection of two detached houses with associated access, parking and landscaping. As the scheme moved towards delivery, the design brief evolved. Rather than starting again with a fresh full application — and the delay, cost and risk that comes with it — we used Section 73 of the Town and Country Planning Act 1990 to vary the approved plans condition and keep the original consent alive.
What we secured
Under this amendment application the Council has agreed to:
- A complete redesign of House 1 — from a two-storey flat-roofed contemporary dwelling to a two-storey traditional design with accommodation in the roof on a virtually identical footprint.
- A new detached garage to the frontage, incorporating the dwelling’s cycle parking provision.
- A squared-off first floor to House 2, bringing the rear of Bedroom 2 level with the master bedroom.
- A tree condition converted from pre-commencement to compliance — removing a discharge hurdle before a spade hits the ground.
Why it succeeded
Branksome Park is a sensitive, verdant setting, and the amendments attracted an objection from the Branksome Park & Canford Cliffs Residents’ Association, who considered House 1 would become a more dominant form of development.
The Case Officer disagreed. The revised design was found to be of high quality and compatible with its surroundings, appropriately scaled to its plot and not appearing cramped, with the garage suitably screened by proposed tree and hedge planting.
Crucially, the Officer concluded the changes remained “materially consistent with the operative part… of the original permission” — the key legal test for any Section 73 application.
The condition win
Converting the tree protection condition from pre-commencement to compliance is a small change with real commercial value. We front-loaded the evidence — a Tree Survey, Tree Constraints Plan, Tree Protection Plan and Arboricultural Method Statement — so the Tree Officer could confirm no further impact on trees and no loss of planting. The result: no separate discharge application, and a cleaner route to commencement.
Thinking of changing an approved scheme?
A Section 73 application is often the fastest, lowest-risk way to amend a live permission — but only where the changes are properly justified against the original decision. If your design has moved on since consent, get in touch with the team at Pure Town Planning and find out how we can help you.
