
Dorset Council: Chris Miell has recently secured planning permission for an infill development at Caesars Way, Corfe Mullen.
The proposal, which was designed by UX Architects, will provide a 3-bed detached dwelling to the side of the existing dwelling. The new home will assimilate comfortably into the streetscene, whilst preserving neighbouring amenity and safeguarding the area’s verdant character through a combination of tree protection and replacement planting.
The application followed a previous submission from 2022, which was refused by the LPA on tree grounds. The landowner challenged the LPA’s decision at appeal and the Inspector found in the appellant’s favour. However, the appeal was dismissed solely on nutrient neutrality grounds. This issue arose during the appeal process and could not be resolved because there were no nutrient credits were available to purchase at that time.
Since then, Natural England have launched their Nutrient Mitigation Scheme for Poole Harbour catchment, which provides a platform for applicants to purchase nutrient credits, which in turn allow them to deliver additional homes that are ‘nutrient neutral’.
On that basis, we submitted a revised planning application to the LPA, which was accompanied by a nutrient neutrality statement and the relevant calculations to demonstrate that nutrient neutrality would be achieved at the site with a credit purchase from Natural England.
Upon review, the application was promptly recommended for approval by the Planning Officer. However, the approval was delayed because the LPA required the applicant to enter into a S106 legal agreement to secure the BNG self-build exemption. After many months of back and forth between solicitors this process was completed and planning permission was granted for the plot split!
Our client was understandably delighted with the decision, which brought to a close an eight year planning process that encompassed three planning applications and an appeal. It shows that in some cases, it pays to be persistent…!
