
Dorset Council: In June 2025, we secured full planning permission for the demolition of an existing dwelling and the erection of a replacement dwelling with associated access and parking on Boundary Lane, St Leonards and St Ives. The site is located within the South East Dorset Green Belt.
Following this, the applicant instructed their architect JOLP LTD to amend the approved plans to improve the quality of the living accommodation within the new dwelling by redesigning the approved roof form to infill the rear balcony area, which in turn will provide additional floor area to bedroom 2. To secure permission for the changes, we submitted a variation of condition application utilising the provisions of Section 73 of the Town and Country Planning Act 1990 (as amended). This sought permission to substitute the approved plans for the amended versions.
In support of the application, we put forward a robust planning justification which explained that as the revised proposal would result in a minor increase to the internal floor area of 13sqm (2% increase in floor area when compared to the approved scheme), the revised proposal would not result in any negative impacts upon the openness of the Green Belt when compared to the approved development
The application was promptly reviewed by the Planning Officer at Dorset Council and planning permission was approved without delay within 8-week target period. In assessing the proposal, the Officer shared our position, concluding within her report that “The proposed development is larger than what was [previously] approved, however, it is not disproportionate compared to the context of what was approved. The proposed development would not harm the openness of the greenbelt. Therefore, on balance, the very special circumstance would outweigh the harm arising by reason of inappropriateness and loss of openness.”
Our client was understandably delighted with the decision and is now making good progress with the building works.
