
BCP Council (Poole): In April 2025, we won an appeal against BCP Council and secured full planning permission for the demolition of the existing dwelling and the erection of two dwellings on Anthonys Avenue, Poole (more details here).
Before starting work, the applicant wished to make minor amendments to the approved plans to improve the living conditions of future occupiers through the introduction of rear balconies to both dwellings. In addition, minor changes were proposed to the internal layout of the new dwellings and the external appearance of the development.
Working with Marlow Architects, we submitted a Section 73 application to BCP Council seeking permission to vary the approved plans list condition.
To support the application, we prepared a planning statement which set out the various changes in a clear and concise matter. We argued that due to the minor nature of the proposed changes, the amendments to the approved scheme would not create any harmful impact upon the character and appearance of the area, nor would the changes compromise the overall design and appearance of the proposed development, which the Planning Inspector previously deemed to be acceptable through the grant of planning permission.
In terms of impact upon the privacy of the occupiers of neighbouring properties, we explained that due to the topography of the site and the separation distance between the new dwellings and neighbouring properties, plus the inclusion of privacy screens, no harmful levels of overlooking would occur as a result of the introduction of rear balconies.
Upon review, the LPA were supportive of the proposed changes and moved to approve the Section 73 application. Our client was understandably delighted with the decision and they are excited to bring forward the redevelopment of this under-utilised site to deliver additional housing in a manner that will improve the character and appearance of the area.
