Henlow certificate of lawfulness paddock to garden change of useCentral Bedfordshire Council: Pure Town Planning recently successfully obtained a certificate of lawfulness for clients at Henlow in Bedfordshire to confirm that the use of a former paddock as garden is lawful. Our client only recently acquired the land but fortunately the previous owner and a neighbour were willing to make Statutory Declarations to confirm that the land in question had actually been in domestic garden use for well over ten years. We drafted the Statutory Declarations and the presented the evidence to the Council as part of the application. The key to a certificate of lawfulness application of this kind is the quality and completeness of the evidence. Statutory Declarations must be precise, consistent and leave no gaps or ambiguity otherwise they may be challenged. In this case the evidence was solid and the certificate was issued within the statutory period.
